STORE OPERATOR AND ACCEPTANCE
TMSA MERCH is an authorized merchandise store operated by SELLARTIFY LLC under an agreement with Triad Math and Science Academy (TMSA Public Charter Schools). By visiting tmsamerch.com, placing an order, or using store services, you agree to these Terms of Service and the policies incorporated into them, including the Return and Refund Policy, Shipping Policy, and Privacy Policy.
If you do not agree, do not use the store or place an order. Mandatory consumer rights under applicable law remain in effect.
PRODUCTS AND ORDERS
Product availability, colors, materials, decoration methods, prices, and descriptions may change without notice. We make reasonable efforts to display products accurately, but screens and production lots can vary. We may correct errors, limit quantities, reject fraudulent or abusive orders, or cancel an order that cannot be fulfilled. If we cancel a paid order, we will refund the canceled amount.
An automated order confirmation acknowledges receipt but does not guarantee acceptance or availability. Acceptance occurs when we begin production or ship the order, subject to applicable law.
CUSTOMER-SUPPLIED INFORMATION AND APPROVALS
Customers are responsible for reviewing and submitting accurate names, spelling, sizes, colors, quantities, schools, personalization, addresses, and other order details. When a proof or approval is requested, production may be delayed until approval is received. Customer-approved proofs and customer-submitted errors are not production defects.
You represent that you have the right to provide any text, image, logo, or other content submitted with an order. You must not submit unlawful, infringing, hateful, misleading, or unauthorized material. We may refuse content or orders that create legal, safety, reputational, or production concerns.
PRODUCTION, CHANGES, RETURNS, AND DELIVERY
Many items are made to order. Production starts quickly and may involve nonrecoverable labor and materials. Changes, cancellations, returns, refunds, and delivery are governed by the policies posted on this store.
Customized, personalized, decorated, printed, embroidered, engraved, monogrammed, made-to-order, and special-order goods are final sale and cannot be returned or exchanged, except for confirmed defects, shipping damage, fulfillment errors, or rights that cannot be waived by law.
PRICING AND PAYMENT
Prices are listed in U.S. dollars unless stated otherwise. Applicable taxes, shipping charges, and other disclosed fees are added at checkout. Payment must be authorized before fulfillment. We may correct pricing errors before fulfillment and will offer the customer the choice to accept the corrected price or cancel for a refund.
INTELLECTUAL PROPERTY
TMSA names, logos, school marks, and TMSA-specific brand assets are owned by or licensed to their respective rights holders and are used with authorization. No purchase transfers any right to reproduce, sell, modify, or commercially use those marks.
SELLARTIFY LLC retains ownership of its production systems, templates, production-ready files, mockups, automation, manufacturing methods, workflows, reusable design elements, and other background materials, except to the extent a signed agreement expressly provides otherwise. Website content may not be copied, scraped, reproduced, or commercially used without written permission.
PROHIBITED USES
You may not misuse the store; interfere with security or operation; use automated tools to extract content without authorization; submit fraudulent orders; attempt unauthorized access; or use store content or products in a manner that violates law or third-party rights.
THIRD-PARTY SERVICES
Payment processors, carriers, Shopify, and other service providers may process information or perform parts of the transaction under their own terms and privacy practices. We are not responsible for third-party services beyond the responsibilities imposed on us by applicable law.
DISCLAIMER AND LIMITATION OF LIABILITY
To the fullest extent permitted by law, the store and its content are provided without warranties beyond those expressly stated. SELLARTIFY LLC is not liable for indirect, incidental, special, consequential, or punitive damages arising from use of the store or products. For a claim relating to an order, aggregate liability will not exceed the amount paid for the affected item, except where applicable law prohibits that limitation.
Nothing in these Terms excludes liability or consumer rights that cannot lawfully be excluded.
CHANGES TO THESE TERMS
We may update these Terms by posting a revised version with a new effective date. The version in effect when an order is placed governs that order unless law requires otherwise.
